General Use COOL Terms & Conditions:

• Minimum overall order quantity - from the Container Section of COOL is a 20’ container, from the Truckload Section of COOL is one T/L and from the Special Buys Section is the lesser of an entire lot or a C/L / T/L. (Note – you may order a lesser quantity than full loads but all the related freight and import costs are for your account)
• By using the COOL feature of “See what else is available from this Mill”, you can see what other items may be combined in the same container/truckload. Minimum order increment of any one item is a pallet.
• Quantities - 5% +/- of the quantity ordered shall constitute compliance with your purchase order and the invoice shall be adjusted according to the quantity actually delivered.
• Access to the COOL website does NOT constitute a right to purchase from COOL. COOL reserves the final right to decide what products to offer to whom under the COOL Program.
• Warranties – COOL in association with the Manufacturer provides the Pre-installation Warranty while the Manufacturer alone provides the Post Installation Warranty. See the individual warranties provided with each SKU for full details as well as the COOL Post Sale Support section
• COOL strives to provide both current and accurate estimates online for all the costs associated with buying and delivering a product to your door. When you indicate your interest in buying, COOL issues you a formal Sales Order after reviewing your order & if necessary adjusting costs. This Sales Order becomes the Firm Quote for the product you are interested in. It may vary slightly from the online estimate (hopefully it will be slightly less – the way we designed the system). You  then issue your Purchase Order accepting the COOL Sales Order.
• COOL shall NOT be held responsible for any inaccurate online estimates given the myriad of elements that change frequently such as supplier costs, duty rates, shipping costs and/or mistakes due to human error in entering costs.
• Prices & Delivery Dates as set forth on the COOL Sales Order are subject to the following conditions:
  1. Delivery – all delivery dates quoted are approximate. COOL shall not be held liable for any losses caused by delays in shipment/delivery caused by accident, labor disturbance, lack of shipping facility, port strikes, truck strikes, vessel sailing schedule changes or delays, mill delays, material shortages, acts of God, customs and agriculture department inspections, etc., which are beyond COOL’s control.
  2. Should duty rates change after shipping the goods as a result of any new governmental duties or other such charges imposed upon the shipment, COOL reserves the right to request these costs be added to your invoice. You then have the right to decline the shipment with the newly added costs w/o penalty. Should you decline to accept the new costs, COOL has the right to sell the container elsewhere.
• Product Availability – all products are listed on COOL based on their having reasonable availability. For COOL reasonable availability means:
  1. Special Opportunity Buys – are offered on a first come, first served basis and are subject to prior sale. These items are typically already manufactured or are available to be completed within 30/45 days by the Manufacturer plus shipping times.
  2. Running Line Products - are usually made to order with manufacturing lead times typically ranging from 3 weeks to 12 weeks plus shipping time.
  3. However, COOL does NOT guarantee product availability nor lead times to be within these time frames given the constantly changing production backlogs and raw material availability for an item.
